Entertainment - Disney Cites First Amendment In Gina Carano Termination Suit | Revry
1 min No genre TV-14Disney argues that firing Gina Carano, after she allegedly trivialized the Holocaust on social media, is protected under the First Amendment. 'The Mandalorian' star was fired in 2021 after she compared the treatment of Jewish people in Nazi Germany to modern-day conservatives in the US. She was also panned for posts about COVID-19 restrictions and the LGBTQ+ community, but antisemitism was "the final straw" for Disney. Carano sued the company for unlawful termination and discrimination, arguing that her personal political views should not affect her employment. Disney argued in a motion that the company has a right to disassociate itself from political views that run "contrary to Disney’s values”. Carano also cited gender discrimination, as Pedro Pascal and Mark Hamill were not punished for comparing Donald Trump supporters to Nazis. Disney's lawyers argued that the First Amendment protects its right to "disassociate from some speech and not others".
